Please read these Terms and Conditions ("Terms") carefully before using GitGUI ("the Software") operated by GitGUI ("us", "we", or "our").
1. Acceptance of Terms
By downloading, installing, or using GitGUI, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not use the Software.
2. License Grant
2.1 License
Upon purchase, we grant you a non-exclusive, non-transferable, limited license to use GitGUI on up to three (3) devices that you personally own and control.
2.2 Restrictions
You may not:
- Redistribute, sell, lease, or sublicense the Software
- Reverse engineer, decompile, or disassemble the Software
- Remove or alter any proprietary notices or labels
- Use the Software for any unlawful purpose
- Share your license key with others
2.3 Updates
Your license includes free updates for three (3) years from the date of purchase. After this period, the Software will continue to function, but you will not receive new features or updates unless you purchase an update extension.
3. Intellectual Property
The Software and its original content, features, and functionality are owned by GitGUI and are protected by international copyright, trademark, and other intellectual property laws.
4. Payment and Refunds
4.1 Payment
All payments are processed securely through Stripe. We do not store your payment information.
4.2 Refund Policy
We offer a 14-day money-back guarantee. If you are not satisfied with GitGUI for any reason, contact us within 14 days of purchase for a full refund.
4.3 Pricing
Prices are subject to change. Any price changes will not affect existing license holders.
5. Privacy
Your use of GitGUI is also governed by our Privacy Policy. The Software does not collect, transmit, or store any of your code, commits, or repository data.
6. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
We do not warrant that:
- The Software will meet your specific requirements
- The Software will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Software will be accurate or reliable
7. Limitation of Liability
IN NO EVENT SHALL GITGUI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Software
- Any unauthorized access to or use of our servers
- Any bugs, viruses, or other harmful code transmitted through the Software
- Any errors or omissions in any content
8. Indemnification
You agree to defend, indemnify, and hold harmless GitGUI and its licensors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Software or violation of these Terms.
9. Termination
We may terminate or suspend your license immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Software will cease immediately.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GitGUI operates, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify or replace these Terms at any time. Material changes will be notified via email or through the Software. Your continued use of the Software after such modifications constitutes acceptance of the updated Terms.
12. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
